An encroachment, as of a right or privilege:
A breach or infraction, as of a law, right, or obligation; violation; transgression.
September 25, 1789 is when the Amendment was written. It wasn't until December 15, 1791 when it was finished and put into operation as the 2nd Amendment that we as Americans hear constantly being "infringed on" as government officials try to make laws on firearm bans as well as harder stipulations of owning certain or any guns. Without the use of black market purchases.
The days of going to a shop and just picking it off the shelf and taking it home without background checks or registering it are long gone. No one is going around Jesse Jamesing it up and not having everything about yourself attached to that gun. It just isn't going to happen. You are obligated to register that firearm and submit paperwork, IDs, Information about yourself, background checks as well as payment for such processes to take place. Just for the Government to tell you if you are allowed to own that gun.
We can see from the top definition of Infringement, that an "Obligation" is an infringement. Right?
I would say yes. As words have meanings and those words say this is what it means.
Now, You can also say that regulating what type of gun you can own is also, an infringement. Correct? Because the first definition is saying any regulation is an infringement. Thats against the Constitution as well.
Well, Federal law provides significant penalties for felons in possession of weapons, unless the felon has his rights restored by the convicting state. 18 U.S.C. 922(g) is the federal law that prohibits anyone ever convicted of any felony to ever possess any firearm either inside or outside of his home. The federal punishment for firearm possession by a felon is up to 10 years in prison.
Whats the third word I typed in that last section? "Law". It is a federal "law" against a person convicted of a felony to own a firearm. You can hear it in all the arguments. "Better background checks to stop felons from obtaining guns." "we need laws so that its harder for criminals to get guns."
18 U.S.C. 922(x) (2) is the federal law on minors from owning any firearm (excluding limited state laws that allow it under other limitations and laws. That is yet another Federal Law Infringing the RIGHTS of a person who is a citizen of this country. A country based on freedom and "Christian Founding".
But isn't the First Amendment the freedom of religion? Its not that we are a christian country. We are a country who had christians as its "Founding Fathers." This isn't a Christian Country where if you are something else, you are wrong. Remember this part for later on...youll understand in a later post.
Now, the fun part for me.
On January 13, 2023, the Attorney General signed ATF final rule 2021R-08F, “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces.' "
If you are like me and you had no idea what a pistol brace or stabilizing brace was before 2023 then youre not alone and most dont care because they dont have one anyway. What they do care about, is that the ATF once said it was legal and then as of Jan 13, 2023 it is now Illegal to own one if youre Rifle or pistol has a barrel that is less than 16". You must alter the gun to meet that criteria, get rid of the gun, or get rid of the brace so that it can't be reattached.
Do you have a pistol brace/Stabilizing brace? No, then you aren't affected by this ruling and you shouldn't be upset.
You do have one? And your barrel isn't less than 16"? Then, who cares?
You do have one. your barrel is less than 16" and you dont want to register it.
Don't.
Its not that hard to not register it. They dont know you have one and if they did, they wouldn't know you haven't registered it. That simple.
But understand that if you don't register it, you are now going against the law and you are now a criminal if you get caught.
This is from the January 13th Ruling as well as what is stated as LAW currently at the time of this post.
ATF Form 1 requires individuals to sign under the penalty of perjury that the description of the firearm, including the type of firearm, is true, accurate, and complete, and that the making and possession of the firearm described in the application would not constitute a violation of Title 18 U.S.C., Chapter 44;
Title 26, U.S.C., Chapter 53; or any provisions of State or local law. Any false statement knowingly made on the ATF Form 1 regarding registration pursuant to this rule is a violation of 26 U.S.C. 5861(1). A firearm involved in a violation of section 5861(1) may be seized, and the violation subjects the person to possible conviction, which is punishable by a fine up to $10,000, or imprisonment up to 10 years, or both.

Furthermore, a willful false statement to an agency of the Federal government may also be a violation of 18 U.S.C. 1001, which is punishable by a fine or imprisonment up to five years, or both. The options for persons in possession of short-barreled rifles equipped with a "stabilizing brace" device to come into compliance with the NFA are outlined in section V.B of this preamble.
That would make you a Felon if you lie on the form and you are caught without such tax stamp or Form filled out, you are breaking a federal ruling and can be imprisoned as well as your firearm destroyed and a fine given to you.
Lets recap just real quick...You have the right to own a firearm to protect yourself according to your 2nd Amendment right as an american citizen and that shall not be infringed. Unless you are a felon and then you can't own any firearm because that's federal law. And now, you aren't registering your pistol/stabalizing brace...which makes you a felon...which under 18 U.S.C. 922(g) Federal law prohibits felons from owning firearms which if caught, they can face up to 10 more years in prison and a fine.
You aren't registering your Pistol brace? Well then, I mean, under your own logic, you should not own that brace or the gun because you are now a felon.
Federal law says so.
Federal law...an infringement, says felons can't own guns.
Law....Infringement...says someone can't own a gun.
You say felons can't own guns.
ATF says you can't own a pistol brace or a SBR with one without registering it.
Laws...Infringments....they are the sam thing but the difference is, you are offended that a gun accessory is now taxed and registered.
The funniest part is that Red blooded gun toting Americans who scream for their 2A right will be the first to say that felons (murderers or anything else classified as a felon) shouldn't own guns. They believe they lost their right because they broke the law. So now, a law (aka infringement) is put into place so that these citizens can't own or possess a firearm which is against their constitutional right as an American.
What I find almost hysterically funnier is that every single one of you or your friends that is mad about the pistol brace/stabilizing brace ruling from the ATF, is constantly bringing up disabled people, when it has nothing to do with interfering with disabled individuals rights...the ATF clearly says that disabled individuals will not be having their rights taken away because of The Rehabilitation Act of 1973 clearly states the Federal actives and programs of the government shall not discriminate against disabled individuals...but also under the definition of program or activities, Firearm is not stated according to 794(b). So their right isn't being infringed. Also, No one is legally allowed to violate the NFA (National Firearms Act). It's not discrimination, it's just how it is for everyone. Again, "legally being the keyword here because you can do anything you would like to do (freedom of religion, speech, press etc etc. ) but you will have consequences such is life. One action trigger another and another...get it...triggers? haha I crack myself up.
AND
The fact that....are you ready?
The Amendment that everyone screams about, clearly and very minimally worded, I believe, states, "...the right of the people to keep and bear Arms, shall not be infringed."
NOT the right of the people to keep and bear arms and accessories.
NOT the right of the people to keep and bear arms with attachments
NOT the right of the people to keep and bear arms with modifications
NOT the right of the people to keep and bear arms with enhancements
NOT the right of the people to keep and bear arms with lasers, sights, bumpstocks, hand grips. etc. etc.

Your constitutional rights aren't being infringed upon with this ATF pistol brace stuff.
I am not talking about ban on weapons. I am simply talking about accessories. such as but not limited to, silencers, sights, lasers, grenade launchers attached to your rifle, pistol braces, front grips, whatever else you would like to add to your set up to make it look sexier or shoot better or make better for your IG, Those aren't firearms. Those are not Rights. Those are not protected under the 2nd Amendment.
Those. Are. Not. Rights. Those are privileges.
Owning a firearm is a right. According to the Amendment. But according to you and the federal government, felons can't have guns because they are felons...sounds like a law to me still. Which if we have learned nothing else today, Infringements are laws or regulations.
If you are screaming about your freedoms and constitutional rights as Americans...But yet you infringe on an Americans who happen to be a felon and their (such as Grand theft auto, larceny, Not turning in ATF forms, Lying about a weapon with a brace) rights under the Constitution that you are saying gives you God Given Rights as an American...are you any different than the ATF or federal government?
******Let me make this very clear for anyone who is just looking for any reason to say im a bigot, bad person, one of them, or whatever uneducated insult you have. I am not Pro Felons. Im not Pro ATF. I am simply looking at the facts of the matter AND attacking the Pro 2A people who are screaming about their infringed rights under the umbrella of 2A when this particular matter has nothing to do with firearms but firearm accessories. I am also not Pro banning guns like Washington State is doing.
I am pro allowing people to do what they want. I am Pro you not paying taxes if you dont want to. I am Pro you owning 305 guns if you chose to do so and start your own milita if you wanted to because that is your right (being necessary to the security of a free state), I am pro you smoking as much weed, popping all the MDMA, growing your own poppy, getting drunk every day of the week if you want, because most importantly I am Pro you being an adult and understanding if you do anything you want under the umbrella of "Freedom" you understand that repercussions will happen, either negative or positive, they will happen and you have the right to make that choice for yourself.
I am looking at what is presented and reading the words that are said and written by our founding fathers that everyone is quoting but no one is paying attention to.

People. Arms.
Two very important words in that short Amendment.
